Terms & Conditions:

Welcome to Certex Training Academy. By accessing or using our website, and by booking our services you agree to be bound by these Terms and Conditions in addition to the Certex standard terms and conditions of sale. If you do not agree with any part of these terms, please do not use our services.

Eligibility for Training:

To be eligible to undertake training with Certex:

Course participants must be 16 years or older.

Course participants must own a photographic driving licence or passport to produce as ID.

Course participants registering onto a LEEA Accredited Refresher Training Course must be able to provide a valid in-date LEEA certificate for the initial or refresher training course of the same name, that will still be in-date on the course start date of the booked refresher course.

Course participants will be required to achieve full attendance to be eligible for sitting the exams on the final day of the course.

Suitability of Training:

It is the customer's responsibility to evaluate the suitability of any training course in relation to their specific requirements, ensuring that it meets their criteria prior to enrolment.

HSE provides guidance on what is meant by competency, stating that:

“Competence can be described as the combination of training, skills, experience and knowledge that a person has and their ability to apply them to perform a task safely.”

They stipulate that a competent person must undertake the necessary training to help acquire and maintain satisfactory competency levels.

This course alone will not deem your employee competent but can be used in conjunction with experience, skills and knowledge to demonstrate overall theoretical and practical competence which can assist you as an Employer to address legal requirements, by contributing to your own assessment of your employee’s potential competency.

Terms of Payment:

All prices are quoted and payable in sterling.

Non-Account Holders: All quoted training must be paid for upfront in order to secure your requested training dates and the number of course places required.

Certex Account Customers: Unless otherwise agreed in writing, all invoices must be paid not later than 30 days from the date of Invoice. All payments shall be made without deduction or set off. Failure to pay for Services shall entitle the Seller to cancel the related order/training and any other order form the Buyer without prejudice to any other right the Seller may have. The Seller reserves the right where genuine doubts arise as to a Buyer’s financial position or in the case of failure to pay for any Services as aforesaid to cancel any order without liability until payment or satisfactory security for payment has been provided.

Training Schedules:

Training finish times may vary dependant on participant numbers, experience and ability of participants. We are unable to commit to early finish times and participants should not book travel based on any finish time other than that advised in the course joining instructions. Certex Training Academy advises all course participants to allow ample time if travelling to our Academies, we do not accept liability or costs for any missed travel connections.

Course Registrations (Late or Non-Registration):

An online registration onto the training course date must be completed by each individual course participant. If no registration is made, course joining instructions cannot be issued.

The training course registration window typically closes 8-14 days in advance of the course start date dependent upon the course to allow final course preparations to be made by the Academy, however we ask all course participants to register within 3 days of receiving their unique registration link to avoid delays in issuing course joining instructions.

In circumstances where a customer books a training course for their employees to attend it is the responsibility of the company order contact to ensure all personnel register before the registration deadline advised expires.

If a company has booked the training course for their employees and the company order contact also wishes to receive a copy of the instructions, this can be facilitated by asking their selected course participants to add the company order contact’s name and the company order contact’s email address into the online registration form, in the ‘Order Contact’ section located on Page Two of the registration form.

Certex recommends this for all company order contacts, as this can assist customers to monitor the registrations and to be aware of who may not have registered. This can help avoid issues associated with late or non-registration.

Where any course participant fails to register onto their allocated course date, before the registration closing date:

3 UK business days or more before the course start date: you can request that the course registration is re-opened for 24 hours, and the participant must then register before 11pm the next day. Contact our Training Administration Team on 01302 756768/1 to request this. Please do not leave voicemail requests.

1-2 UK business days before the course start date: you can request that the course registration is re-opened for 12 hours, and the participant must then register within the agreed time. Contact our Training Administration Team on 01302 756768/1 to request this. Please do not leave voicemail requests

Please note that we can only action your requests during a UK business day during business hours, therefore for courses starting on a Monday, or on a Tuesday following a bank holiday, it is important that your request reaches us on the Friday before the course start date by between 9am and 2pm to allow time for us to action your request. Please do not leave voicemail requests.

For all late registrations, where catering has been agreed to be provided by Certex, no lunch will be available for those registering onto the course late if they have specific dietary requirements or where the buffet has already been pre-booked therefore participants should be advised to bring a packed lunch with them. No refunds or reimbursements will be due in these circumstances

After 2pm on the final UK business day before the course start date the registration window will lock and it will be too late to register onto the booked course date meaning 100% of the course cost will be forfeited.

Course Joining Instructions:

Course joining instructions are automatically generated and issued by the Certex Training Academy Portal once a training course has been booked, paid for, and an online registration onto the training course date has been completed by each course participant.

If a company has booked the training course for their employees and the company order contact also wishes to receive a copy of the instructions, this can be facilitated by asking their selected course participants to add the company order contact’s name and the company order contact’s email address into the online registration form, in the ‘Order Contact’ section located on Page Two of the registration form.

Certex recommends this for all company order contacts, as this can assist customers to monitor the registrations and to be aware of who may not have registered. This can help avoid issues associated with late or non-registration.

Amending a Training Booking

Customers can amend a booking in three ways.

  • Substitution of one or more persons attending for alternative person/s.
  • Reschedule the course date
  • Cancel the course place (or date in the case of private courses).

All requests must be made in writing to training@certex.co.uk.

The date of the email making your request to reschedule or cancel the course, will be the date used to calculate your notice period. To help us to help you, please title your email request with your preferred action e.g. [Course Cancellation/Reschedule/Substitution Request] followed by your Certex Order Number.

Please Note: For the avoidance of doubt, where the term ‘UK Business Day’ is used, this excludes weekends and UK bank holidays.

Any fee’s due will be subject to VAT where applicable and are applied on a per person, per occurrence basis unless stated otherwise.

Course Cancellation:

Course places can be cancelled for any person attending a public course at a Certex Training Academy. Dependant upon the notice period provided, a fee may be incurred. Fees are detailed below.

For private courses due to be held on a customer’s own site or at one of the Certex Venues, customers may cancel (or reschedule) the whole booking, but not individual course places. Please refer to the section ‘Customer Site or Private Course Rescheduling:’ for further guidance on available alternative options.

Where a customer wishes to cancel a private course date, scheduled to be held at their own site, any cancellation fee due will be calculated excluding travel and accommodation quoted costs, unless these costs have already been incurred at the point of notifying Certex that you wish to cancel. In this instance, any expenses incurred will be added at cost (+VAT) to the fee charged.

Cancellation Fees:

*In the case of Appointed Persons, Mobile Crane Examination or Crane Supervisor courses, please refer to the Mobile Crane Course Cancellation section.

61 or more days before the start date: No Cancellation Fee. Paid invoices will be credited.

30- 60 days before the start date: 50% Cancellation Fee.

0 - 29 days before the start date: 100% Cancellation Fee.

*Mobile Crane Course Cancellation Fees:

61 days or more before the course start date (excluding start date): £325 Cancellation Fee

30- 60 days before the start date: 50% Cancellation Fee.

0 - 29 days before the start date: 100% Cancellation Fee.

Course Rescheduling:

Public Training Academy Course Rescheduling:

(This section applies to courses due to be attended at a Certex Training Academy site. It excludes training courses booked as private courses for one company’s employee’s only.)

Should customers need to make changes to the course dates booked, they may request to reschedule, to later course dates only, as follows for individual course participants. Any associated fee is per person, per occurrence.

Please note that to be eligible for rescheduling, you are required to have:

Paid any associated fee and have committed to a new course date no later than 1pm on the last UK business day before the original course start date.

If no payment has been received and confirmed by 1pm on the last UK business day before the course start date, 100% of the course cost will be forfeited and rescheduling will not be permitted.

Payment of the fee can be made by PO (if your order was originally paid by PO) or must be made by card over the telephone (AMEX not accepted), or by same day bank transfer. BACs payment can only be accepted in cases where 7 or more business days remain between you raising the payment and the course start date due to bank processing times.

Rescheduling Fees:

*In the case of Appointed Persons, Mobile Crane Examination or Crane Supervisor courses, please refer to the Mobile Crane Course Rescheduling section.

32 days or more before the course start date (excluding start date): No Rescheduling Fee

15 - 31 days before the course start date (excluding start date): 25% Rescheduling Fee

3 - 14 days before the course start date (excluding start date): 50% Rescheduling Fee

1 - 2 UK business days before the course start date (excluding start date): 75% Rescheduling Fee

*Mobile Crane Course Rescheduling Fees:

Applies to Appointed Persons, Mobile Crane Examination or Crane Supervisor courses per person, per occurrence.

32 days or more before the course start date (excluding start date): £325 Rescheduling Fee

7-31 days or more before the course start date (excluding start date): £650 Rescheduling Fee

1 – 6 UK business days before the course start date (excluding start date): 75% Rescheduling Fee

Customer Site or Private Course Rescheduling:

(This section applies to courses booked as private courses for one company’s employee’s only, either on a customer’s own site or at a Certex Training Academy).

Should customers need to make changes to the course dates booked, they may request to reschedule, to later course dates only, for the whole group. Should any individuals be unable to attend, we advise substituting an alternative employee into their course place as once booked, private course places are non-refundable. Any associated course date rescheduling fee is per booking. In the case of courses being held on a customer site, rescheduling fees will be calculated excluding our quoted travel and accommodation expenses provided we have not yet incurred those costs. However where travel or accommodation related costs have been incurred by Certex, these will be passed onto the customer at cost (+VAT) in addition to the standard rescheduling fee.

Please note that to be eligible for rescheduling, you are required to have:

Substitution of Course Participants:

Customer Site or Private Course Participant Substitution:

In circumstances where the customer has booked multiple dates for delivery of the same private course (either on their own site or at our Training Academy), the customer is permitted to transfer any number of course registrants between their booked course dates, upto the maximum permitted course numbers per course date, provided these personnel are already registered onto one of the proposed course dates. There will no charge made for any date change requests made before 2pm on the last UK business day ) before the original course start date. We advise short notice changes are actioned over the phone to ensure you have instant confirmation that your change request has been actioned. Please contact our Administrator on 01302 756768/1 for assistance. Please do not leave voicemail requests for this purpose.

Where the customer wishes to enrol someone new onto the course, to replace someone who cannot attend, they should refer to the ‘General /Public Course Participant Substitution’ section.

General/Public Course Participant Substitution:

Where an existing registered course participant is unable to attend on their booked date, customers can request to substitute any participant for another person (with the required pre-requisites where applicable) at no charge at any point upto the deadlines specified.

Please follow the steps below to substitute a course participant.

**Step One: **Send an email request titled: ‘Substitution Request’ to training@certex.co.uk providing:

  • Course Name
  • Course Date
  • Full name of the person who you wish to be removed from the course
  • Full name of the replacement course participant
  • Contact telephone number of the replacement course participant
  • Email address of the replacement course participant

The deadline for sending this email is 11am (GMT) 2 UK business days before the course start date.

**Step Two: **Provide your replacement course participant with telephone number 01302 756 761 and ask them to telephone us between 9.30am- 2pm on any UK business day to register onto the course over the phone. (This cannot be done via email; a phone call is required). The telephone registration must be completed no later than 2pm one UK business day before the course start date to ensure course joining instructions can be issued to the new participant before the course start date. Registrations after this deadline will not be accepted and the course place forfeited. Please make them aware that if they are unsuccessful in reaching us, they must try again until successful in completing their telephone registration. Voicemail requests are not accepted as we are required to review medical history with the course participant in order to assess their fitness to participate in the training.

To try and help you we will also make 1 attempt per day to contact your replacement course participant between 9.30am- 1pm Mon-Fri (excl bank holidays) if we have not been contacted in the meantime.

We will reply to your original email request to confirm once the substitution has been successfully administered or to confirm if we are having difficulty in contacting the replacement course participant.

Where lunch is being provided by Certex, please note that no special dietary requirements can be catered for if substitutions are made less than 8 days in advance of the course start date. Please notify your affected personnel to make alternative arrangements.

Please Note: It is the customer’s responsibility to ensure that we are successfully contacted as specified, therefore we advise substituting with as much advance notice as possible to provide time for the substitute’s registration to be completed. Substitution requests made after 11am two UK business days or less before the course start date will be rejected and treated as re-schedule or cancellation as preferred by the customer.

Non-Attendance or Lateness:

If a course participant is unable to attend the course on the course start date, for whatever reason, 100% of the course cost will be forfeited and rescheduling is not permitted, except in the case of ‘Snow Days’. Please refer to the relevant section for further information.

Course participants are requested to arrive at the Training Academy or on-site training location no later than 8.45am. If travelling, we strongly advise arriving the day before the training course start date to prevent traffic/travel related issues occurring. Training begins at 9am prompt. We can be contacted on 01302 756761 if you wish to notify us of any delays. Any course participant arriving on or after 9.30am will strictly not be permitted to participate in the training. course due to missing essential content. 100% of the course cost will be forfeited and rescheduling will not be permitted.

Snow Days:

In the event that a course participant is unable to attend the course on the scheduled start date due to adverse snow conditions rendering travel unsafe, it is imperative that they contact us at 01302 756768/1 or via email training@certex.co.uk before 8:45 AM on the course start date. Provided that contact is made by the specified time, participants will be rescheduled for a new course date at one of the Certex Training Academy locations at no additional charge. Please note that specific dates or locations cannot be guaranteed, and the allocation of these remains at the discretion of the Training Manager.

Certification & Grade Appeals:

Certification will not be issued unless the training course assessments has been passed. In the case of LEEA Certificates, these will be issued to the company training contact not the course participant, within 14 business days after the training has been successfully completed.

In the rare event that you wish to challenge an assessment result; you should make an appeal in writing to the Harworth Training Manager at training@certex.co.uk. Please title your email ‘Assessment Result Appeal Request.’

Following receipt of your request, an independent re-assessment will be conducted.

If the independent re-assessment upholds the original assessment result, the person appealing will be advised accordingly.

If the independent assessor reaches the conclusion that the participant should be awarded a higher grade, the person appealing will be advised in writing and an official complaint raised internally so that the incident can be fully investigated. Additionally, if the independent assessor awards the participant a ‘pass’ where previously the participant had failed, electronic training records will be updated to reflect the new grade, and a certificate will be generated and issued accordingly.

Complaints:

Complaints must be made in writing to the Harworth Training Manager at training@certex.co.uk, who is responsible for logging and processing your complaint. Please title your email ‘Complaint’ and provide full details and your contact telephone number.

Course Cancellation by Certex:

Whilst we try to avoid cancelling training, Certex reserve the right to postpone or cancel a course if operational demands or extreme weather conditions mean that it is not viable or safe to run the course. In this event, all participants and course organisers will be notified and placed onto alternative course dates.

Course organisers and course participants are strongly advised to book accommodation or travel that may be changed or refunded due to the unlikely event that Certex must postpone or cancel a course for operational reasons. Certex will not be responsible for lost deposits, cancellation charges, or any form of travel costs incurred.

Intellectual Property:

Website content and all training materials, including text, images, and logos, are the property of Certex or our Accrediting Bodies and as such are protected by copyright and trademark laws.

You may not reproduce, distribute, or otherwise use any content without our prior written consent. Where use is permitted, all assets remain the property of Certex and may not be reproduced or copied in anyway.

Limitation of Liability:

Certex shall not be liable, whether in contract or by way of indemnity or tort (including but not limited to negligence) or for loss of contracts, loss of profits or use or any other economic loss resulting from any default. We strive to provide accurate information but do not warrant that all content is complete, error-free, or up-to-date.

Amendments to Terms and Conditions:

Certex reserves the right to modify these Terms and Conditions at any time.

Force Majeure:

Neither Certex, the customer or the course participant shall be liable to the other for any failure to perform any part of the agreement which is due to an event beyond the control of either party, including but not limited to terrorism, war, political insurgence, strike, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made eventuality which may cause the termination of the event.


Medical Self Assessment

When registering for training courses you must report to your training provider any health conditions that they should be aware of.

It Is Your Responsibility To Report Heath Issues

The following conditions could pose a risk when you participate in our training courses. You must alert your training provider if you suffer from any of the following:

  • Asthma or other respiratory disorders
  • Epilepsy, blackouts or other seizures
  • Angina or other heart complaints
  • Vertigo or inner ear problems (difficulty with balance)
  • Claustrophobia/acrophobia (fear of enclosed spaces/heights)
  • Blood pressure disorder
  • Diabetes
  • Pacemaker or implanted defibrillator
  • Arthritis, osteoarthritis or other muscular/skeletal disorders affecting mobility
  • Known allergies (e.g., bee/wasp stings or spider bites)
  • Recent surgery
  • Any other medical condition or medication dependency that could affect climbing or the physical impact of climbing
  • Problems with lifting

Should there be any doubt regarding your medical fitness, the training provider will stop the training and seek a physician’s advice.

> By accepting the "Terms and Conditions" at the point of registration you are confirming that you have read and understood the listed risks and potentially life-threatening medical conditions and, confirm that you are physically and medically fit to participate in our training.
